Overview
Whenever an Indian resident or business makes a payment to a Non-Resident (foreign entity) outside India, the Income Tax Department wants to ensure that applicable Tax Deducted at Source (TDS) has been paid. To monitor this, the RBI and IT Department mandate the filing of Form 15CA (a declaration by the remitter) and Form 15CB (a certificate issued by a Chartered Accountant). The CA examines the invoice, the Double Taxation Avoidance Agreement (DTAA) with the foreign country, and certifies the exact rate of TDS to be deducted before the bank processes the wire transfer.

Is Form 15CB mandatory for all foreign payments?▼
No. Form 15CB (CA Certificate) is not required if the remittance is for imports of physical goods (covered by Bill of Entry), or if the total remittances during the financial year do not exceed Rs. 5 Lakhs (only Part A of 15CA is required).
What is a Tax Residency Certificate (TRC)?▼
A TRC is a document issued by the foreign government proving the vendor pays taxes in that country. Without a TRC, the Indian entity cannot apply the lower DTAA tax rate and must deduct a flat high TDS (often 20% or 40%).
