Overview

A trademark is the single most valuable intangible asset of an enterprise, establishing customer goodwill and distinct brand recognition in the marketplace. In India, trademark registration is governed by the Trade Marks Act, 1999 and the Trade Marks Rules, 2017, administered by the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM). Registering your trademark grants you the exclusive legal right to use, license, or franchise the mark across India in connection with the designated goods or services under the applicable Nice classification classes. Unregistered brand names are vulnerable to imitation, counterfeiting, and predatory squatting, leaving businesses with only common-law passing off remedies, which are notoriously burdensome and expensive to enforce. By securing statutory registration, you obtain prima facie evidence of legal ownership, the nationwide right to prevent unauthorized commercial usage, and the authority to initiate civil or criminal infringement proceedings against infringers, claiming statutory injunctions and monetary damages. Our specialized IPR attorneys handle every phase—from preliminary clearance audits to final certificate issuance.

Step-by-Step Trademark Registration Procedure

Our step-by-step advisory workflow.

1

Step 1: In-Depth Clearance Search & Class Selection

We perform a phonetic, visual, and conceptual search across the official trademark registry database and common law records to eliminate conflict risks.

2

Step 2: TM-A Drafting & Electronic Filing

Our IPR advocates prepare Form TM-A with precise item descriptions, apply eligible 50% MSME government fee rebates, and submit the filing on the IP India portal.

3

Step 3: Immediate ™ Allocation & Status Tracking

You receive the official filing acknowledgement with the TM application number within hours, legally entitling you to display the ™ symbol.

4

Step 4: Examination & Trademark Journal Publication

The registry examines the mark under Sections 9 and 11. Once cleared (or upon overcoming objections), the mark is advertised in the official Trademark Journal for 4 months.

5

Step 5: Registration Certificate Issuance

If no opposition is filed during the 4-month advertisement period, the Registrar issues the Digital Registration Certificate, unlocking the ® symbol.

Frequently Asked Questions

Helpful answers to common regulatory inquiries.

What is the key difference between the ™ and ® symbols in India?▼

The ™ symbol is an informal notification indicating that a trademark application has been filed and the brand owner claims common-law rights over the mark. The ® symbol indicates that the trademark has completed the full statutory examination and publication process and has been formally registered. Displaying the ® symbol before receiving the official registration certificate is an offence under Section 107 of the Trade Marks Act, 1999.

How long is a trademark valid once registered in India?▼

A registered trademark in India is valid for a period of 10 years from the date of initial application. It can be renewed indefinitely every 10 years by filing Form TM-R along with the statutory renewal fee within the prescribed timeline.

What are the official government fees for trademark registration?▼

For Individuals, Startups (DPIIT recognized), and Micro/Small/Medium Enterprises (with valid Udyam Registration), the official government filing fee is ₹4,500 per class for electronic filing. For other entities (such as private limited companies without MSME status, public companies, or partnerships), the official fee is ₹9,000 per class.

What happens if another party is already using a similar name?▼

If our clearance search identifies an identical or deceptively similar trademark in the same or related class, proceeding with registration carries a high risk of Section 11 objection or third-party opposition. Our legal team will advise on strategic modifications, distinctive additions, or selecting an alternate distinctive wordmark to guarantee smooth approval.

Can I apply for a trademark before launching my product or service?▼

Yes. You can file a trademark application on a "Proposed to be Used" basis. You are not required to provide prior invoices or sales evidence at the time of filing. Once registered, your legal priority dates back to the original application date.
