Overview

A registered trademark is not entirely unassailable. Under the Trade Marks Act, 1999, the law provides mechanisms to cleanse the Register of marks that were wrongfully registered, have become generic, or have been abandoned by their owners. Under Section 57, an "aggrieved person" can file a petition for rectification to cancel or vary a trademark registration on grounds of fraud, misrepresentation, lack of distinctiveness, or contravention of provisions of the Act. Furthermore, under Section 47, a registered trademark can be expunged on grounds of non-use if it was registered without any bona fide intention to use it, or if there has been no bona fide commercial use of the mark for a continuous period of 5 years and 3 months prior to the date of the application for rectification. Rectification petitions represent high-stakes commercial warfare, frequently initiated to counter infringement lawsuits or eliminate trademark squatters holding blocking registrations. JRC Legal’s litigation team handles both sides of rectification—whether expunging wrongful blocking marks or aggressively defending registered clients against cancellation petitions.

Step-by-Step Trademark Rectification Lifecycle

Our step-by-step advisory workflow.

1

Step 1: Grounds & Locus Standi Audit

We establish that the applicant qualifies as an "aggrieved person" and identify whether Section 47 (non-use) or Section 57 applies.

2

Step 2: Petition Drafting (Form TM-O / High Court Petition)

Our senior advocates draft the formal petition outlining specific statutory grounds, supported by legal precedents and sworn affidavits.

3

Step 3: Filing & Service of Notice

The petition is filed with the Registrar or High Court and formally served on the registered proprietor of the impugned mark.

4

Step 4: Counter-Statement & Evidence Affidavits

The proprietor files their Counter-Statement within 2 months, followed by exchange of evidence affidavits in support and reply.

5

Step 5: Final Hearing & Order

Counsel argue the matter before the Registrar or High Court Single Judge, resulting in a binding order expunging, modifying, or retaining the mark.

Frequently Asked Questions

Helpful answers to common regulatory inquiries.

Who qualifies as an "aggrieved person" to file for trademark rectification?▼

An "aggrieved person" is anyone whose commercial interests are substantially prejudiced or hampered by the presence of the mark on the register. This includes competitors selling similar goods, applicants whose own marks are blocked by the impugned mark, or defendants in trademark infringement suits.

What is the 5-year non-use rule under Section 47?▼

Under Section 47(1)(b), a trademark can be cancelled if, up to 3 months before the date of the rectification application, a continuous period of 5 years or longer has elapsed during which the trademark was registered and there was no bona fide commercial use in India.

Where can a rectification petition be filed?▼

Following the Tribunals Reforms Act, 2021, a rectification petition can be filed either before the Registrar of Trade Marks (at the appropriate jurisdictional office) or directly before the High Court having territorial jurisdiction.

What is the government fee for filing a rectification petition?▼

The official government fee for filing an application for rectification on Form TM-O before the Registrar of Trade Marks is ₹9,000 for electronic filing. Court fees vary if filed directly before the High Court.

Can a registered proprietor defend against a non-use claim if non-use was due to special circumstances?▼

Yes. Under Section 47(3), non-use will not result in cancellation if the proprietor proves that it was due to "special circumstances in the trade" (such as import restrictions, government embargoes, or regulatory delays) and not due to an intention to abandon the mark.
