Overview

Following the submission of an industrial design application, the Designs Wing of the Patent Office in Kolkata conducts an examination to verify compliance with the formal and substantive provisions of the Designs Act, 2000. In a large majority of filings, the Examiner issues a First Examination Report (FER) raising formal objections (such as improper perspective alignment, poor image contrast, lack of clarity in novelty statements) or substantive objections under Section 4 (alleging that the design is not significantly distinguishable from prior known designs or has been previously published). Under Rule 18 of the Designs Rules, 2001, the applicant must overcome all objections within a strict statutory period of 6 months from the official filing date (extendable by 3 additional months upon filing Form-4). If the applicant fails to comply within this deadline, the application is deemed to have been abandoned. Crafting an effective design objection reply requires technical drafting skills to re-render compliant drawing views combined with legal argumentation proving visual distinctiveness under judicial eye-appeal standards. JRC Legal defends design applications to secure granted status.

Frequently Asked Questions

Helpful answers to common regulatory inquiries.

What is the deadline to file a reply to a Design Examination Report?▼

Under Rule 18 of the Designs Rules, the applicant must overcome all objections within 6 months from the original date of filing the application. An extension of 3 additional months can be sought by filing Form-4 along with statutory extension fees before the expiry of the 6 months.

What is the test of "eye-appeal" in design objection jurisprudence?▼

Under Indian design law, a design is judged solely by the eye. The visual distinctiveness is evaluated from the standpoint of the ordinary consumer. If the overall visual impression of the new design creates a distinctly different eye-appeal from prior art, the objection under Section 4 must be waived.

What happens if the Controller is not satisfied with the written response?▼

If the written reply is deemed insufficient, the Controller will issue a Hearing Notice giving the applicant an opportunity to appear (virtually) and demonstrate novelty before the application is refused.

What are the government fees for seeking an extension of time (Form-4)?▼

The official statutory fee for filing Form-4 for a 3-month extension is ₹500 for natural persons/MSMEs/startups, and ₹2,000 for standard corporate entities.

Can I add new views or alter the shape of the product during the objection reply?▼

No. You cannot introduce any new visual features or substantially alter the shape of the product. The revised drawing sheets must strictly reflect the article as originally submitted, only correcting technical rendering defects.
