Overview

In an era where product appearance dictates consumer purchasing decisions, the visual design of a product is one of its greatest competitive advantages. Industrial design protection in India is governed by the Designs Act, 2000 and Designs Rules, 2001, administered by the Patent Office in Kolkata. Design registration protects only the visual and aesthetic features of shape, configuration, pattern, ornament, or composition of lines or colors applied to any article—whether two-dimensional or three-dimensional—by any industrial process. It does not protect the functional mechanism or mode of operation (which falls under Patent law). To be registrable, a design must be strictly "new or original" and must not have been disclosed to the public anywhere in India or abroad prior to the filing date. Once registered, the proprietor obtains a legal copyright in the design for an initial period of 10 years (extendable by 5 additional years to a total of 15 years), giving them the exclusive right to prevent competitors from manufacturing, importing, or selling products bearing identical or pirated visual appearances.

Step-by-Step Design Registration Procedure

Our step-by-step advisory workflow.

1

Step 1: Novelty Audit & Locarno Classification

We audit public records to ensure the visual shape has not been previously published and assign the correct Locarno class.

2

Step 2: Technical Drawing & Novelty Statement Drafting

Our technical illustrators prepare standard 7-view representation sheets conforming strictly to Patent Office formatting rules.

3

Step 3: Application Filing on Form-1

We submit the application on Form-1 to the Controller of Designs, Kolkata, claiming MSME fee benefits where eligible.

4

Step 4: Examination & Office Action Disposal

The examiner reviews the design for prior art and distinctiveness. If objections are raised, our attorneys file a written rebuttal within 3 months.

5

Step 5: Grant & Official Journal Notification

Upon acceptance, the design is recorded in the Register of Designs, published in the Patent Office Journal, and the registration certificate is issued.

Frequently Asked Questions

Helpful answers to common regulatory inquiries.

What is the key difference between a Patent and a Design Registration?▼

A Patent protects the internal functional mechanism, working principle, or inventive process of a product. A Design Registration protects exclusively the external visual appearance, shape, configuration, and ornamentation of an article, irrespective of its internal mechanics.

Can I apply for design registration after launching or selling the product in the market?▼

No. Under the Designs Act, 2000, "absolute novelty" is a mandatory prerequisite. If the product has been publicly displayed, sold, advertised, or published on the internet anywhere in the world prior to the filing date, it ceases to be new and cannot be registered.

How long does Design Registration protection last in India?▼

A registered design is valid for an initial period of 10 years from the date of registration. It can be extended for an additional period of 5 years (total 15 years) by filing Form-3 along with the renewal fee before the expiry of the initial 10-year period.

What are the government fees for design registration in India?▼

For Natural Persons, Startups, and Small Enterprises (with valid Udyam MSME certification), the official government filing fee is ₹1,000 per application. For other corporate entities (large enterprises), the official fee is ₹4,000.

Which office handles all design registrations in India?▼

Under the administrative structure of CGPDTM, all industrial design applications in India are centralized and prosecuted exclusively through the Designs Wing of the Patent Office located in Kolkata.
