Patent Registration & Filing in India (Provisional & Complete)
Protect your groundbreaking technical inventions, software innovations, and hardware devices under the Patents Act, 1970.
Overview
A Patent is the highest form of intellectual property protection, conferring an exclusive 20-year legal monopoly over an invention to the exclusion of all others under the Patents Act, 1970 and Patents Rules, 2003. Administered by the Indian Patent Office (operating across Delhi, Mumbai, Chennai, and Kolkata under the CGPDTM), a patent protects novel products, industrial machines, chemical compositions, pharmaceutical formulations, electronic devices, and technical hardware-software integrated systems. To qualify for a patent, an invention must satisfy three rigid statutory pillars: it must be strictly "Novel" (never published or disclosed anywhere in the world), must involve an "Inventive Step" (must not be obvious to a person skilled in the art), and must be capable of "Industrial Application". Innovators frequently begin by filing a Provisional Specification to secure an immediate, unshakeable priority date while continuing R&D, followed by a Complete Specification within the mandatory 12-month window. Patent claims define the precise boundary of your commercial monopoly: drafting them requires master-level techno-legal expertise. JRC Legal’s registered Patent Attorneys and technical patent agents guide you from prior-art search to patent grant.

Step-by-Step Patent Registration Lifecycle
Our step-by-step advisory workflow.
Step 1: Prior Art Search & Patentability Audit
We conduct rigorous novelty searches across WIPO, USPTO, EPO, and Indian patent databases to confirm inventive steps.
Step 2: Techno-Legal Specification & Claims Drafting
Our patent agents draft the Complete Specification (Form 2) including detailed description, embodiments, and independent/dependent claims.
Step 3: Formal Filing (Form 1 & Form 2)
We file the patent application on the official portal, locking in your priority date and claiming eligible MSME fee concessions.
Step 4: Publication in the Official Patent Journal
The application is published after 18 months (or within 1 month if filing Form 9 for Expedited Publication).
Step 5: Request for Examination (Form 18) & FER Response
We file Form 18 triggering substantive examination. Upon issuance of the First Examination Report (FER), we draft and file a comprehensive legal response.
Step 6: Hearing & Grant of Patent
Our patent attorney attends the hearing before the Controller of Patents if required. Upon satisfaction, the Patent is granted and letters patent issued.

Frequently Asked Questions
Helpful answers to common regulatory inquiries.
What is the difference between a Provisional and a Complete Patent Specification?▼
A Provisional Specification is a preliminary filing submitted when an invention is still in the developmental or testing stage. It secures an immediate, legally binding priority date at minimal cost. The applicant must file the Complete Specification (with detailed claims) within 12 months from the provisional filing date; otherwise, the application is deemed abandoned.
Can computer software or business methods be patented in India?▼
Under Section 3(k) of the Patents Act, "a mathematical or business method or a computer programme per se or algorithms" are not patentable. However, under the revised CRI (Computer Related Inventions) Guidelines, software inventions that demonstrate a technical effect, solve a technical problem, or are integrated with specific novel hardware architectures are fully patentable.
What are the government filing fees for patents in India?▼
Under the amended Patent Rules, Startups, Small Entities (MSMEs with Udyam Registration), and Natural Persons enjoy an 80% government fee concession. The official filing fee (Form 1) is ₹1,600 for MSMEs/Startups versus ₹8,000 for large corporate entities. Request for Examination (Form 18) is ₹4,000 for MSMEs versus ₹20,000 for large entities.
How long does it take for a patent to be granted in India?▼
Under the standard track, patent prosecution from filing to grant typically takes 2.5 to 4 years. However, if the applicant qualifies for Expedited Examination (Form 18A)—available to Startups, MSMEs, female inventors, and green tech firms—patents can be granted in as fast as 12 to 18 months.
Can I publicly disclose or publish my invention before filing a patent?▼
No. In India, public disclosure, marketing, sale, or scientific publication of an invention prior to filing a patent application destroys novelty. You must file at least a Provisional Patent Application before discussing your technology with third parties or publishing it.
