Overview

Under Section 25 of the Trade Marks Act, 1999, a registered trademark in India is valid for a period of 10 years from the original application date. To maintain uninterrupted statutory protection, the registered proprietor must renew the trademark every 10 years by filing Form TM-R along with the prescribed statutory fee. The renewal window opens 6 months prior to the expiration date. If an applicant fails to renew the mark before the expiry date, the Registrar sends a notice on Form O-3. The mark enters a grace period during which it can be renewed with late fees within 6 months after expiry. If renewal is still neglected, the Registrar removes the trademark from the register. Even after removal, the law provides a lifeline under Section 25(4): the proprietor may apply for Restoration and Renewal within 1 year from the date of expiration of the last registration. Allowing a valuable trademark to lapse permanently results in catastrophic loss of brand exclusivity, leaving your company name open for competitors to register. JRC Legal manages timely renewals and emergency restorations across all trademark classes.

Strategic Benefits of Timely Trademark Renewal

Guarantees uninterrupted monopoly over your brand name without legal lapses.

Advantage 01

Perpetual Brand Monopoly

Unlike patents which expire after 20 years, a trademark can be renewed perpetually every 10 years, securing multi-generational brand protection.

Advantage 02

Unbroken Legal Priority

Maintains an uninterrupted chain of ownership dating back to your original filing date, preserving common-law and statutory seniority.

Advantage 03

Prevents Brand Hijacking & Squatting

Prevents opportunistic third parties from claiming your established brand name the moment it drops into the public domain.

Advantage 04

Preserves Commercial Valuation & IP Collateral

An expired trademark loses its balance sheet valuation and invalidates commercial licensing and franchising royalty agreements.

Advantage 05

Emergency Restoration Capability

If you have missed your renewal deadline within the last 12 months, our attorneys can restore your mark to active status.

Frequently Asked Questions

Helpful answers to common regulatory inquiries.

When should I file for trademark renewal?▼

You can file for renewal anytime within 6 months before the expiration date of the trademark. Filing early ensures that your renewal is processed smoothly without risking late penalties.

What is the government fee for trademark renewal in India?▼

The official government fee for standard electronic renewal (Form TM-R) is ₹9,000 per class (or ₹10,000 for physical filing). If renewing within the 6-month grace period after expiration, an additional statutory late fee of ₹4,500 per class applies.

Can I restore a trademark if more than 6 months have passed since expiration?▼

Yes. Under Section 25(4), you can apply for "Restoration and Renewal" within 1 year from the date of expiration. The statutory fee for restoration and renewal is ₹18,000 per class for electronic filing.

What happens if I do not renew my trademark within 1 year of expiry?▼

If more than 1 year has elapsed since the expiration date, the trademark is permanently removed from the Register. In such a scenario, the mark cannot be restored, and you must file a fresh trademark application (Form TM-A), losing your historical priority date.

Can I make changes to my logo or wordmark during renewal?▼

No. Form TM-R is strictly for renewing the mark as originally registered. If you wish to modify your logo or alter the brand name, you must file a separate application for trademark amendment (Form TM-M) or file a fresh trademark application.
