Overview
A Director Identification Number (DIN) can be deactivated by the MCA primarily for two reasons: failure to file the annual DIR-3 KYC by September 30th, or disqualification under Section 164(2) of the Companies Act because a company where the individual is a director failed to file financial returns for 3 consecutive years. No. The Rs. 5,000 penalty for late DIR-3 KYC is hardcoded into the MCA portal and cannot be waived under any circumstances.
What if I am disqualified under Section 164(2)?▼
If disqualified, simply filing KYC will not reactivate the DIN. You must either clear the defaults of the defaulting company (by filing its pending returns) or wait out the 5-year disqualification period. In some cases, High Court writ petitions can offer relief.
