Overview

Under the Foreign Manufacturers Certification Scheme (FMCS), the Bureau of Indian Standards (BIS) regulates the import of goods into India that are covered under mandatory Quality Control Orders (QCOs). Governed by Scheme-I of the BIS (Conformity Assessment) Regulations, 2018, FMCS is the only legal mechanism through which an overseas manufacturing facility located outside India can obtain authorization to apply the ISI Mark to its products. Notified goods—ranging from steel products, chemicals, and industrial fasteners to toys, tyres, and sanitaryware—cannot cross Indian customs borders without a valid FMCS license. FMCS is an intensive, high-stakes regulatory process: it requires the foreign manufacturer to appoint a legally liable Authorized Indian Representative (AIR), undergo a physical on-site factory audit by an Indian BIS technical officer at their overseas plant, pay statutory inspection charges, furnish a Performance Bank Guarantee (PBG) of USD 10,000, and pass testing of sealed samples in Indian laboratories. JRC Legal acts as the comprehensive compliance partner, managing overseas plant preparation, AIR services, and liaison with BIS headquarters.

Step-by-Step BIS FMCS Certification Procedure

Our step-by-step advisory workflow.

1

Step 1: AIR Appointment & Standard Gap Audit

We establish the statutory AIR arrangement, review factory test apparatus, and verify compliance with Indian Standard (IS) specifications.

2

Step 2: Technical Dossier Compilation & Form-I Submission

We draft the technical documentation and submit the official Form-I application to the FMCD division at BIS Headquarters, New Delhi.

3

Step 3: Factory Inspection Protocol & Logistics

BIS appoints an inspecting officer. We coordinate visa clearances, itinerary approvals, and inspection fee remittances.

4

Step 4: On-Site Overseas Factory Audit

The BIS officer conducts a physical inspection of the overseas plant, witnesses sample testing, and seals samples for Indian lab testing.

5

Step 5: Sample Dispatch & Independent Testing in India

Sealed samples are shipped to India under customs clearance and tested in designated BIS-recognized laboratories.

6

Step 6: PBG Submission & Grant of FMCS License

Upon passing independent testing, the manufacturer furnishes the USD 10,000 PBG, pays marking fees, and receives the official CM/L license.

Frequently Asked Questions

Helpful answers to common regulatory inquiries.

Who can act as the Authorized Indian Representative (AIR) under FMCS?▼

The AIR must be an Indian resident entity. It can be a registered Indian branch office of the foreign manufacturer, a subsidiary, an Indian distributor, or an authorized Indian legal advisory firm like JRC Legal. The AIR is legally responsible for ensuring compliance with the BIS Act and handling regulatory inquiries.

Is a physical factory visit by an Indian BIS officer mandatory for overseas plants?▼

Yes. Under FMCS Scheme-I, a physical, on-site audit of the foreign manufacturing premises by a BIS technical officer is strictly mandatory. Remote, digital, or virtual audits are not permitted under any circumstances.

What is the Performance Bank Guarantee (PBG) requirement for FMCS?▼

Upon successful factory inspection and lab testing, the foreign manufacturer must submit a Performance Bank Guarantee (PBG) of USD 10,000 issued by a recognized bank having branches in India. The guarantee remains with BIS during the tenure of the license.

How long does the entire BIS FMCS certification process take?▼

On average, the FMCS lifecycle takes between 4 to 6 months, depending on the speed of dossier clearance, auditor travel visa processing, and laboratory test durations in India.

Who bears the travel and inspection costs of the visiting BIS officer?▼

The foreign applicant is responsible for all statutory inspection charges, international airfare, local transportation, hotel accommodations, and per diem allowances for the visiting BIS officer as per official government rules.
